The Maryland Commissioner of Financial Regulation finalized regulations, which became effective Dec. 29, 2008, requiring that certain information about involved mortgage originators and lenders be recorded along with “residential property” deeds of trust and mortgages.
Ala. bill requires redaction of SSN, birth date prior to recording
A bill has been introduced in the Alabama legislature that would authorize probate judges to redact, remove or otherwise make illegible a Social Security number or birth date appearing on certain recorded documents relating to real or personal property recorded.
Buyers breach of contract claim against insurer fails
A Minnesota appellate court concluded that property owners failed to establish their breach-of-contract claim against a title insurer, finding that the buyers claimed losses related to land outside of the legal description included in the policy.
Construction loan snafu lands title company in hot water
A Pennsylvania court dismissed conversion, breach of fiduciary duty, detrimental reliance, and equitable relief claims against a title company where construction loan funds were alleged to have been disbursed in violation of the instructions of the borrower, but refused to dismiss a negligence claim, opining that it was unclear at this stage in the litigation whether there was a valid contractual relationship between the parties.
Title agent seeks $5M in wrongful prosecution suit
A former Pennsylvania abstract company owner that was ultimately cleared last year of allegations that she was involved in two fraud cases has sued the state attorney general, prosecutors and investigators for $5 million, claiming the ordeal left her severely depressed and unable to attain another job in the title insurance industry.
